THE EQUINE COLLABORATIVE LLC

Terms of Service

Effective Date: May 14, 2025

These Terms of Service ("Terms") govern your access to and use of the website theequinecollab.com, online membership, courses, and related services (collectively, the "Services") provided by The Equine Collaborative LLC, a Montana limited liability company ("Company," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years of age to use our Services or purchase a membership. By using our Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

2. Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Membership and Subscriptions

We offer monthly and annual membership plans that provide access to online video content, educational materials, and other member benefits.

Billing. Your membership will be billed on a recurring basis (monthly or annually) using the payment method you provide. You authorize us to charge your payment method automatically at the start of each billing period.

Cancellation. You may cancel your membership at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to member content through the end of your paid period.

Refunds. We do not offer refunds for partial membership periods or unused portions of a subscription. If you believe you have been charged in error, contact us within 30 days and we will review your request.

Price Changes. We reserve the right to change membership pricing with at least 30 days' notice. Continued use of the membership after the effective date of a price change constitutes acceptance of the new price.

4. Hands-On Courses and Events

We offer in-person certification courses, owner clinics, and other events held in Belgrade, Montana and other locations.

Registration. Course registration is complete upon receipt of payment. Enrollment is subject to availability.

Cancellation by You. Course tuition is non-refundable. If you need to cancel your course enrollment, please notify us as soon as possible. Cancellations made more than 30 days before the course start date may be eligible for a credit toward a future course. Cancellations made within 30 days are subject to a transfer fee. Transfers to another course date may be accommodated at our discretion.

Cancellation by Us. We reserve the right to cancel or reschedule courses due to low enrollment, instructor illness, weather, or other circumstances beyond our control. In the event of a cancellation by us, you will receive a free transfer to future dates, full refund or credit at your election.

Health and Safety. Participation in hands-on equine courses involves inherent risks. By enrolling, you acknowledge these risks and agree to follow all safety instructions provided by our instructors. We reserve the right to remove any participant who poses a safety risk to themselves, other participants, or animals.

5. Intellectual Property

All content available through our Services, including videos, course materials, diagrams, text, images, and logos, is the property of The Equine Collaborative LLC or its licensors and is protected by copyright and other intellectual property laws.

Your membership or course enrollment grants you a limited, personal, non-transferable, non-exclusive license to access and view content for your own personal, non-commercial use. You may not:

Download, copy, reproduce, or distribute course content without our written permission

Share your account login with others

Use our content for commercial purposes, including teaching or reselling

Remove or alter any copyright, trademark, or other proprietary notices

6. Disclaimer of Warranties

OUR SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The educational content we provide is for informational purposes only. Equine massage and bodywork techniques carry inherent risks. Always consult a licensed veterinarian regarding your horse's health and treatment. We are not veterinarians and our content does not constitute veterinary advice.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE EQUINE COLLABORATIVE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Assumption of Risk and Release

By participating in hands-on courses and events, you acknowledge that equine activities involve inherent risks of injury and you voluntarily assume those risks. To the maximum extent permitted by Montana law, you release and hold harmless The Equine Collaborative LLC, its members, instructors, and affiliates from any claims arising from your participation in our in-person events.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Equine Collaborative LLC, its members, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; or (c) your infringement of any third-party rights.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Gallatin County, Montana, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on our Site with a new effective date. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you by email.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Equine Collaborative LLC regarding your use of our Services and supersede any prior agreements or understandings.
